Wyoming caps the charge on dealer credit sales up to $75,000, taxes the price after your trade-in, and gives no right to cure before repossession.

Updated By Lenditia Editorial Team 6-minute read No right to cure

In short

Under the Wyoming Uniform Consumer Credit Code, a dealer credit sale with up to $75,000 financed may carry at most 36% a year on the first $1,000 of the balance and 21% on the rest. Above $75,000, the rate is whatever the contract says. We found no cap on doc fees, and counties include them in the taxable price. The state sales tax is 4%, plus local tax, on the price minus your trade-in. Wyoming gives no right to cure before repossession.

How much a Wyoming car contract can charge

A dealer-arranged loan is a retail installment contract, which Wyoming's Uniform Consumer Credit Code calls a consumer credit sale. Section 40-14-212 limits the credit service charge, figured with the actuarial method, and lets the seller use whichever of two limits is greater.

Amount financedMaximum charge
$75,000 or less, option A36% a year on the first $1,000, 21% on the rest
$75,000 or less, option B21% a year on the whole balance

On a typical car contract, option A is the larger limit, so the ceiling is a little above 21%. A seller may also charge a minimum credit service charge of up to $30. Banks and credit unions follow their own rules. Compare the APR on every offer and see what it costs in dollars with the car payment calculator.

The same article of the code also covers delinquency and deferral charges, your right to pay the contract off early, and the rebate of unearned charges when you do. Read the late-charge clause in your contract before you sign, since it tells you what a missed payment will cost.

Fees and taxes on a Wyoming purchase

  • Doc fee. We found no Wyoming statute that caps it. County treasurers count documentation fees as part of the taxable price.
  • Sales tax. The state rate is 4% (a 3% base tax plus 1% more), and county taxes are added. The rate follows your principal place of residence.
  • Trade-ins. The state's sales and use tax statement for vehicle sales subtracts the trade-in allowance, and any manufacturer rebate assigned to the dealer, from the price before the tax is figured. A cash down payment does not reduce it.
  • Where you pay. The tax is paid to the county treasurer, and Campbell County says it is due within 65 days of the purchase date, with penalties and interest after that.

Falling behind on a car loan in Wyoming

The remedies article of Wyoming's Consumer Credit Code has no right-to-cure section, so state law does not require a notice and a grace period before the lender acts on a default. Your contract defines default. After default, the lender may repossess without a court order as long as it does not breach the peace. If you expect to miss a payment, call the lender before the due date and ask, in writing, about an extension or a new due date. Keep a record of every call.

  1. Repossession. The agent may take the car from a street or driveway, but not by force or threats. Ask for any personal items left inside.
  2. Notice before the sale. The lender must tell you when and how it will sell the car.
  3. Your chance to redeem. Until the sale, you can get the car back by paying the full balance plus the lender's costs.
  4. Small sales. If the cash price was $1,000 or less, you are not personally liable for the unpaid balance after a repossession or surrender (W.S. 40-14-503). Above that, you can owe a deficiency.
