Nevada Car Loan Laws

Nevada lets buyer and dealer agree on any finance charge, but it limits what counts as default and requires a detailed notice before a repossessed car is sold.

Updated By Lenditia Editorial Team 6-minute read No right to cure

In short

Under Nevada's retail installment sales law, the finance charge on a dealer contract may be any amount the parties agree on. We found no statute or regulation that caps the dealer doc fee. Sales tax starts at 6.85% and reaches 8.375% in Clark County, with your trade-in excluded. There is no right to cure before repossession, but default counts only if you miss a payment or the lender's prospect of being paid is significantly impaired. After repossession the lender must give at least 10 days' written notice before it sells the car.

What a Nevada car contract can charge

Chapter 97 of the Nevada Revised Statutes governs a retail installment contract for goods, cars included. NRS 97.195 says the finance charge and other charges may be any amount agreed upon by the parties, so there is no legal ceiling on the rate a dealer can write into your contract.

  • State forms. When a dealer takes your credit application and the sale creates a security interest, it must use the application and contract forms the Commissioner of Financial Institutions prescribes (NRS 97.299). Spanish versions are required to exist.
  • Prepayment refund. If you pay the contract off early and it has not been in default for more than 2 months, you are entitled to a refund of unearned finance charges (NRS 97.225).
  • No waivers. A clause that waives your rights under chapter 97 has no effect (NRS 97.275).

With no cap, shopping is your only protection on price. Bring a preapproval from a bank or credit union and check the dealer's offer in the car payment calculator.

Fees and taxes on a Nevada car purchase

  • Document fee. We found no cap in NRS or NAC chapter 482. A dealer may leave document preparation charges out of an advertised price only if it identifies them separately and states the amount (NAC 482.150).
  • Sales tax. The base rate is 6.85%, and county rates run higher: 8.375% in Clark County and 8.265% in Washoe County. A dealer collects it on the price you actually pay.
  • Trade-in. The allowance a dealer gives for a used vehicle taken in trade is not part of the taxable sales price (NRS 372.065).
  • Private sales. The DMV says sales between private parties, family sales and gifts are not subject to sales tax.
  • Governmental Services Tax. Each year at registration you pay a tax of about 4% of a DMV valuation that starts at 35% of the original MSRP and shrinks as the car ages.

Falling behind on a car loan in Nevada

Nevada does not require a notice and a cure period before repossession. It does narrow what default means: under NRS 97.304, whatever the contract says, a default is enforceable only if you fail to make a payment or the prospect of payment, performance or realizing on the collateral is significantly impaired, and the seller must prove the impairment.

  1. Notice of intent to sell. After repossession the holder must give you at least 10 days' written notice before it sells or leases the car again (NRS 482.516).
  2. Contents. The notice must state your right to redeem, the total needed to redeem, where the car will be returned and whom to pay. Reinstating the contract by paying only what is past due is available only if the holder offers it.
  3. Deficiency. You can be held liable for a shortfall only if the notice went out within 60 days after repossession and itemized the balance and the repossession and collection costs.
  4. Shutdown protection. A federal, state or tribal worker, or a member of that worker's household, who shows proof is protected from repossession during a government shutdown and for 30 days after it ends (NRS 482.5165).

Where to check a lender and complain

Chapter 97 does not require a dealer or the company holding your contract to be licensed. Lenders that make loans in Nevada need a license from the Commissioner of Financial Institutions under NRS chapter 675, and banks and credit unions answer to their own regulators. Violations of chapter 97 are enforced by the Attorney General and district attorneys.

Nevada Financial Institutions Division

Licenses installment lenders and prescribes the vehicle credit application and contract forms.

Nevada Attorney General

Enforces the retail installment sales law and takes consumer complaints about dealers.

Consumer Financial Protection Bureau
